The grievances are sustained in part and denied in part. The Company had
sufficient and reasonable cause to discipline Grievant for the conduct in question but the
penalties imposed in this case were too severe. Grievant's written reprimand with five
days off of October 18,2007, is reduced to a written reprimand. Grievant's discharge of
March 14,2008, is reduced to a written reprimand with five days off without pay.
Grievant is reinstated to his former classification with all seniority and benefits, and is
awarded back pay without interest from the date of his discharge to the date of his
reinstatement less any unemployment compensation he received that he is not required by
law to repay, and less any wages he received from employment he obtained during this
time in lieu of employment with the Company.
